3. ELIGIBILITY: The Contest is open only to legal residents of Massachusetts (the “Territory”) who are at least eighteen (18) years old at the time of entry. Void where prohibited by law. Individuals (and members of their households and immediate families) who have, within the six (6) month period immediately prior to the Contest start date, performed services in any capacity (including, but not limited to, as employees, consultants, independent contractors, and interns) for Contest Sponsor and/or Contest Administrator; their respective parents, subsidiaries, affiliates or successors, and/or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, (the “Promotional Entities”) are not eligible to enter. The Contest is subject to all applicable federal, state and local laws and regulations. Contest constitutes entrant's full and unconditional agreement to these Official Rules and Contest Sponsor and Contest Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
   
4. TIMING:

The Contest begins at 12:00:00am ET, September 29, 2008, and ending at 11:59:59pm ET, October 12, 2008 (the “Contest Period”). Contest Administrator’s computer is the official time keeping device for the Contest.

CONTEST ENTRY: During the Contest Period, visit www.ABCDWTSSHOWUSYOURMOVES.com/Boston (the “Website”), and fill out the online entry form completely by providing your name, home address, phone number, date of birth, gender and email address and submit a video following the entry instructions (including those for submitting the video and agreeing to all terms and conditions), and clicking on the “submit” button (each, a “Video Entry” and each participant who completes these requirement an “Entrant”).  Limit one (1) Video Entry per person during the Contest Period. Entry is not complete until Entrant has followed the online prompts to upload the digital file containing their Video Entry and affirmatively accepted the Official Rules and Release and Grant of Rights.  Normal Internet access and usage charges, if any, imposed by your on-line service, may apply.

Video Entry Requirements:

  • The Video Entry should showcase some of the Entrant's favorite moves that have been depicted on Dancing with the Stars on ABC.
  • Entrants may introduce themselves at the beginning of the Video Entry, but are not required to do so.

The Video Entry must meet the following guidelines as determined in the Contest Sponsor and Contest Administrator's sole discretion:

  • Video Entry must be 60 seconds or less.
  • Video Entry must be less than 7 MB in size.
  • Video Entry must have two (2) people performing; no more or no less.  Entrant must have the full rights and authority from the person that appears in the Video Entry with the Entrant.
  • Video Entry must only utilize the music tracks provided on the Website.  Entrant may use multiple tracks or just one track.  Any Video Entry containing music other than the provided tracks will be disqualified.
  • Video Entry must be submitted in one of the following formats: avi, mov, mpg or wmv.
  • Finalists will be asked to sign a written release stating that their videos may be disseminated in any media.
  • Only the individual submitting the video is qualified to win the runner up or grand prizes.

The Video Entry must meet the following content restrictions:

  • Video Entry must be entirely entrant's original work and not infringe on rights of any third party.
  • Video Entry must NOT contain more or less than two (2) performers.
  • Video Entry must NOT contain material which is sexually explicit, obscene, pornographic, violent, (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing.
  • Video Entry must NOT have been entered in any other competition or violate the rights of other parties.
  • Video Entry must NOT include mention or performance of any copyrighted media production including but not limited to music (except the songs provided), films, books, television programming, etc., or identifying descriptions of any media property.
  • Videos must NOT include 3rd party trademarks, logos, insignia, location signage, photographs, artwork, or sculpture.
Entrants who submit Video Entry which violate any of these requirements may be deemed ineligible to receive the prize and their Video Entry may be void at the Contest Sponsor or Contest Administrator’s sole discretion. Contest Sponsor or Contest Administrator reserve the right to disqualify in their sole and absolute discretion any Video Entries deemed inappropriate or that do not comply with the Contest Website's Terms of Use. Video Entries may not contain any derogatory references to Contest Sponsor or Contest Administrator. Contest Sponsor and Contest Administrator reserve the right to determine in their sole discretion which Entrants have satisfied the entry requirements. Eligible Entrants must submit in accordance with these rules. No other method of submission will be accepted.

CONTEST JUDGING: The Video Entries will be judged in the following four (4) criteria: (a) Energy and Enthusiasm; (b) Creativity; (c) Overall Impact; and (d) Having Fun – Knowledge and execution of specific techniques and choreography is not absolutely necessary. Five (5) individuals whose entry earns the highest overall score, as determined by Contest Administrator, based on the criteria above will be declared First Prize Winners. In the event of a tie, the First Prize Winners will be selected based on the criteria described in (a), then (b), then (c) and finally (d). One (1) individual selected amongst the five (5) First Prize Winners whose entry earns the highest overall score, as determined by the Contest Sponsor, based on the criteria above will be declared the Grand Prize winner. In the event of a tie, the Grand Prize Winner will be selected based on the criteria described in (a), then (b), then (c) and finally (d) Contest Administrator and Contest Sponsor will be fair and impartial. Decisions of the Contest Administrator and Contest Sponsor will be final. Odds of winning depend on number of eligible Entries received and quality of submitted Video Entries. Judging for the First Prize Winners and Grand Prize winner will be completed on or about October 27, 2008. Judging for the potential Grand and First Prize Winners will be complete on or about October 16, 2008; the Grand Prize Winner will be selected on or about October 27, 2008.

   
7.

CONTEST PRIZES:

            (a)      One (1) GRAND PRIZE: One (1) Grand Prize will be awarded.  Winner will receive a 3-day/2-night trip for winner and a guest to Los Angles, CA and two VIP tickets to the opening night performance of Dirty Dancing musical at The Opera House in Boston on February 7, 2009.  For the Los Angeles trip, WCVB-TV will provide round-trip coach class airfare on Jet Blue for both the winner and guest from Boston/Logan Airport to Los Angeles.  ABC will provide hotel accommodations at the Beverly Wilshire (single room/double occupancy) for two nights, two (2) tickets to the finale of Dancing with the Stars on November 24, 2008, and ground transportation to and from the hotel to the finale. The winner and guest must have travel commence on November 23, 2008.  If winner is unable to travel on requested dates, the prize will be forfeited.  Dates subject to change at Contest Sponsor or Contest Administrator’s sole discretion.  In the event either or both Dancing with the Stars and/or Dirty Dancing is cancelled or postponed for any reason, Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner.  Travel companion must travel on same itinerary and at the same time as the Grand Prize Winner.  All travelers must possess valid travel documents.  Once scheduled, the itinerary cannot be altered.  The ARV depends upon winner’s point of travel origin. The difference between any stated value and actual value will not be awarded to winner. (Approximate Retail Value [“ARV”] of the Grand Prize is: $1600.00).

            (b)      Four (4) First Prizes: Four (4) First Prizes will be awarded. Dancing with the Stars poster autographed by one of the hot season 7 pairs. (Approximate Retail Value [“ARV”] of each First Prize is: $10.00).

For all Prizes: No cash equivalent for the prizes, prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

Grand Prize Winner’s Video, First Place Winner’s Videos and any other Videos selected by the Contest Sponsor or Contest Administrator, may be shown in an on-air broadcast or the Internet. Contest Sponsor and Contest Administrator are under no obligation to use, broadcast, show on the Internet or publish any Video Entry.

   
8.

ALL POTENTIAL CONTEST WINNERS ARE SUBJECT TO VERIFICATION BY CONTEST SPONSOR AND CONTEST ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST.

   
9. CONTEST LIMITATIONS: Each Entry must be received by 11:59:59pm ET, October 12, 2008. Only one (1) Video Entry per person/Address regardless of whether one person has more than one Address, or more persons than one use the same Address. In event of a dispute regarding the identity of the person submitting a Video Entry, such Entry will be deemed to have been submitted by the person in whose name the Address is registered. Entries by any method other than set forth in Rule Number 5 are void.  Any use of an automated system, contest entry service or other automated mechanism to submit Video Entries is prohibited and will result in disqualification. Neither the Promotional Entities, nor any of their officers, directors, shareholders, employees, attorneys, agents or representatives (individually and collectively, “Releasees”) are responsible for: [1] The submission of Video Entries by persons residing, or physically located, outside the Territory; [2] Video Entries that are altered, defective, delayed, deleted, destroyed, failed, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, invalid, late, lost, misrouted, multiple, not delivered, stolen, tampered with, unauthorized or unintelligible; [3] any printing, production, technical, electronic or other errors; [4] lost, interrupted or unavailable network, server or other connections or miscommunications of any kind; [5] failed computer hardware or software transmissions or other technical failures; [6] unauthorized human intervention; [7] Internet traffic congestion or capacity limitations; [8] garbled or jumbled transmissions; [9] undeliverable e-mails resulting from any form of active or passive e-mail filtering; [10] insufficient capacity in entrant’s e-mail account to receive e-mail; and [11] any other errors of any kind, whether due to electronic, mechanical or human error, or other causes, even if caused by the negligence of any of the Releasees. Any Video Entry described in clauses [1] through [11] above will be disqualified. Void where prohibited or restricted by law, and subject to all applicable federal, state, local and municipal laws and regulations.
   
10. CONFIDENTIALITY: Information provided by Contest winners and participants is subject to the Terms of Use policies of the Contest Sponsor, which may be viewed on the Website.
   
11.

ENTRANT'S PERSONAL INFORMATION: Information collected from entrants is subject to the Sponsor’s Privacy Policy which may be viewed on the Website.

   
12.

WARRANTY: : It is an express condition of submission and eligibility that each entrant warrants and represents that entrant's Video Entry is solely created by entrant for the purpose of entering this Contest, and that no other party has any rights or interest in the Video Entry. Entrant further represents and warrants that the Video Entry and any use thereof by the Contest Sponsor and Contest Administrator, and each of their respective parent companies, subsidiaries and affiliates in connection with programming, advertising, promotion and publicity, shall not infringe upon any statutory or common law copyright and shall not constitute a defamation, or invasion of the right of privacy or publicity, or infringement of any other right of any kind of any third party.  By submitting, the entrant grants sponsor a non-exclusive license to broadcast, disseminate, or otherwise exploit the video entry in any media.

   
13. INDEMNITY: Entrant shall indemnify, defend and hold harmless the Promotional Entities, and each of their respective parents, affiliates, successors, assigns and licensees, and each of their respective employees, shareholders, officers, directors, contractors, agents and representatives from and against any and all liability, claims, loss, damage, injury or expense, including reasonable attorneys' fees, arising out of or in connection with any third party action arising out of or resulting from (i) Entrant's participation in the Contest, (ii) a breach or allegation which if true would constitute a breach, of any of Entrant's representations, warranties or obligations herein, (iii) acceptance, possession, or use of any grant or prize, including without limitation, personal injury, death and property damage arising there from and/or (iv) use of any of the rights granted by entrant.
   
14. NOTIFICATION OF AND REQUIREMENTS FOR WINNERS: Potential Grand and First Prize Contest winners will be notified via e-mail, telephone, and/or, at the Contest Sponsor’s discretion, U.S. Mail, on or about October 16, 2008.  The Grand Prize Winner will then be selected, and the Grand Prize Winner and First Prize Winners will be notified on or about October 27, 2008. Disqualification and the selection of an alternate winner may result from any of the following: [1] a potential winner’s failure to respond to notification within three (3) days; [2] the return of any notice or prize as undeliverable; [3] a potential winner’s failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with a winning Video Entry; [4] potential Grand Prize winner’s failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release and other documents as required by Contest Sponsor or Contest Administrator within forty-eight (48) hours after verbal contact; [5] potential winner’s failure to claim a Grand Prize or First Prize within twenty-four (24) hours after it is sent; [6] potential winner’s failure to validly claim any prize before October 21, 2008; [7] potential Grand Prize winner’s failure to be available to complete the Trip by November 25 2008; and [8] any other non-compliance with the Rules. Grand Prize winner and guest must travel together on same itinerary; and guest must be 18 or older unless the Grand Prize winner is the guest’s parent/legal guardian (“Parent”).   The guest (or, if applicable, the guest’s Parent) will be required to execute and return a Release of Liability prior to ticketing.  Grand Prize winner and guest are solely responsible for obtaining any and all necessary travel documents (valid photo I.D., etc.) before departure. All taxes are solely the responsibility of each winner; and each Grand Prize winner will receive an IRS Form 1099 reflecting the final actual value of the Grand Prize. Sponsor will not replace any lost or stolen tickets, vouchers, certificates or other prize items once they are in a Grand Prize winner's possession.  Entrant waives the right to assert as a cost of winning a prize any and all costs of verification and redemption or travel to redeem said prize and any liability which might arise from redeeming or seeking to redeem said prize. The Rules and the list of winners will be posted on the Contest Sponsor’s Website through March 12, 2008.   If winner is unable to travel on November 23rd-November 25th, 2008 to attend the Dancing With The Stars final performance show on November 24th, winner will forfeit their prizing and an alternate winner will be selected.
   
15. CONDITIONS: The Contest Sponsor's decisions are final and binding as to all aspects of the Contest. By entering the Contest and, if applicable, each participant represents, warrants, and certifies to the Releasees that participant has the full right and authority to so participate, and that (s)he has the full legal right, permission, and authority to submit the video included in his/her Video Entry.  Each participant agrees that: [1] he/she will abide by and be bound by the Rules and the Contest Sponsor’s decisions with respect to the Contest; [2] the Video Entry becomes the sole property of the Contest Sponsor and will not be acknowledged; [3] THE RELEASEES ARE NOT RESPONSIBLE FOR CLAIMS, INJURIES, LOSSES OR DAMAGES OF ANY KIND RESULTING, IN WHOLE OR IN PART, WHETHER DIRECTLY OR INDIRECTLY, FROM THE AWARDING, DELIVERY, ACCEPTANCE, USE, MISUSE, POSSESSION, LOSS OR MISDIRECTION OF ANY PRIZE; PARTICIPATION IN THE CONTEST, ANY ACTIVITY OR TRAVEL RELATED THERETO, OR FROM COMPUTER DOWNLOADING IN CONNECTION WITH EITHER THE CONTEST; [4] THE PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE); [5] except where prohibited by law, winner’s acceptance of a prize constitutes the grant of a perpetual, worldwide right to use each winner's name, address (city and state only), voice, likeness, photograph, entry materials (including, without limitation, the recipes that are a part thereof), biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation; [6] in the event of the occurrence of viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Contest Sponsor’s reasonable control corrupt, prevent or impair the administration, security, fairness or proper play of the Contest so that, in the Sponsor’s sole discretion the Contest cannot be conducted as originally planned, the Sponsor has the right to cancel and modify, terminate or suspend the Contest, as the case may be; and in such event to terminate the Trip and return the Grand Prize winner and guest to any airport of origin as soon as reasonably possible; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [8] any portion of any prize not accepted or used by the winner will be forfeited; [9] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [10] Contest Sponsor has the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest, to be acting in violation of the Rules or applicable laws; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; [11] As any attempt by an entrant or any other individual to deliberately alter or damage the Website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, Sponsor shall have the right to seek damages and all other available remedies against such person; [12] If any provision of the Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the Rules and shall not affect the validity and enforceability of the remaining provisions; and [13] Any dispute that arises regarding the meaning and interpretation of the Rules shall be resolved by applying the laws of Massachusetts, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts located within that state.
   
16. LIMITATIONS OF LIABILITY: Releasees are not responsible for: [1] any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; [2] technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; [3] unauthorized human intervention in any part of the entry process or the Contest; [4] technical or human error which may occur in the administration of the Contest or the processing of entries; or [5] any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Contest. No more than the stated number of prizes will be awarded.
